Landscape Genie Terms of Use

Landscape Genie is an independent California C-27 contractor directory and introduction service. We are not CSLB, a contractor, an insurer, an employment agency, or a party to any homeowner-contractor agreement. You choose whom to contact and remain responsible for checking current license status, insurance, scope, pricing, permits, and written contract terms.
1. Acceptance and eligibility
These Terms form an agreement between you and Landscape Genie and the operator of LandscapeGenie.com (collectively, “Landscape Genie,” “we,” “us,” or “our”). By browsing, submitting a project request, using a contractor or administrator portal, requesting a review, or otherwise using the service, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the service.
You must be at least 18 years old and legally able to agree to these Terms. The service is designed only for California projects and California C-27 contractor information. A person acting for a company or property owner represents that they have authority to do so.
2. Directory information, ranking, and featured placement
Contractor information begins with public California Contractors State License Board records and may be supplemented by administrator-approved contractor information. Public records can be delayed, incomplete, or changed after our snapshot. “Clear,” classification, bond, workers’ compensation, issue-date, expiration-date, address, and related labels are informational snapshots, not real-time legal conclusions.
- Always verify current information directly with CSLB before hiring or paying anyone.
- ZIP proximity is approximate and may use mailing ZIPs, ZIP centroids, or geocoded business addresses.
- Mailing addresses can be business addresses, residences, shared offices, or PO Boxes.
- A featured result is a disclosed promotional placement and is not an endorsement or a finding that the contractor is the best choice.
- Distance, order, rating, and review information do not guarantee availability, quality, price, safety, insurance, or project outcome.
3. Project requests and contractor introductions
A homeowner may select up to four displayed contractors. When you submit, you instruct us to send the contact details, project ZIP, address if provided, project answers, and notes you entered to each selected contractor that is configured to receive the request. If direct delivery is not active, a contractor-specific copy may be sent to the Landscape Genie administrative inbox for follow-up. Selected contractors do not receive one another’s email addresses through our batch.
A request is an introduction, not a bid, contract, offer, acceptance, appointment, warranty, or promise of response. Landscape Genie does not negotiate or supervise the work, collect project payments, set contractor prices, guarantee a response, or become a party to any later agreement. Homeowners and contractors must independently confirm identity, authority, scope, pricing, permits, scheduling, license status, insurance, warranties, and legally required contract disclosures.
Submit only accurate information for a genuine project. Do not include Social Security numbers, payment-card or bank information, medical records, immigration information, access codes, alarm codes, or other unnecessary sensitive information in notes or messages.
4. Email, calls, and text messages
Transactional email
By submitting a project request or requesting portal access, you agree to receive transactional email needed to provide the requested service, including project receipts, reference numbers, security codes, review notices, and reminders. A homeowner receipt may include a clearly identified Graystone insurance advertisement; its primary purpose remains confirming the requested transaction. When a contractor records a project start date or marks work finished, we may email the homeowner a contractor-entered milestone notice and secure review link. These notices promote a shared record; they do not amend the parties’ contract or prove that a milestone is accurate.
Selected-contractor communications
The project form identifies each selected contractor by name. By checking the consent box, you authorize each named contractor—acting as a separate sender—to call, text, or email you individually about that project. Consent is project-specific, is not a condition of browsing or purchasing, and does not authorize unrelated Landscape Genie marketing. Message frequency varies. Message and data rates may apply. To revoke text consent, reply STOP to the applicable sender; to request assistance, reply HELP or contact that sender directly. Revoking one contractor does not automatically revoke consent for another contractor.
Landscape Genie SMS program, where offered
If you separately opt in to receive Landscape Genie text messages, messages may be delivered using Twilio or another communications provider. Messages will identify Landscape Genie, relate to the subject described at opt-in, and may include one-time codes, project updates, reminders, or support. Message frequency varies; message and data rates may apply. Reply STOP, CANCEL, END, QUIT, UNSUBSCRIBE, or OPTOUT to stop; reply HELP for help. We may send one final confirmation after an opt-out. Carriers are not liable for delayed or undelivered messages. Consent is not a condition of purchase. We do not presently offer a general promotional SMS subscription unless a separate, clearly labeled opt-in is displayed.
You are responsible for providing a number you control and notifying us if it changes. Automated delivery is not guaranteed, and carrier filtering, device settings, outages, or incorrect contact information can delay or prevent delivery.
5. Call-button tracking
A click or tap on a contractor telephone link may be recorded as a call-intent event. It does not establish that a call connected, identify what was discussed, or measure call duration. The site does not record the audio of an ordinary click-to-call telephone call.
6. Reviews, project photos, audio, and California recording consent
A homeowner may open the project center using the lead reference and original project email after a connected contractor marks work finished. A contractor may also request a review through an associated completed-project lead. Landscape Genie may contact the homeowner to verify feedback, rating, display-name choice, project photos, and publication permission. Reviews are published only after administrator approval. Approval does not mean we independently verified every statement or project result. We may reject, edit for privacy or formatting with permission, unpublish, or delete content that is unlawful, misleading, irrelevant, unsafe, duplicative, or inconsistent with these Terms.
Before uploading photos, you must own them or have permission to submit and publish them, and must check for faces, children, license plates, addresses, access points, documents, or other private details. You grant Landscape Genie a nonexclusive, worldwide, royalty-free license to store, reproduce, resize, display, and distribute approved review content solely to operate and promote Landscape Genie and the associated contractor profile. You retain your ownership.
California generally requires consent from every party before recording a confidential communication. No one may start a review recording until all participants have been told and have consented. Permission to participate is separate from permission to publish. Audio is optional; a review may be approved without it. Landscape Genie may require a consent attestation or signed PDF and may refuse or remove audio when consent cannot be documented. A homeowner self-recording must contain only that homeowner’s voice; it must not capture a contractor, administrator, telephone call, or other confidential communication.
7. AI-assisted and automated features
Where enabled, Landscape Genie may use rules, statistical methods, or AI-assisted tools to organize project answers, identify likely work categories, rank directory records, summarize information, detect spam or abuse, assist moderation, or draft operational communications. Automated output can be incomplete or wrong. It is not legal, licensing, contracting, engineering, safety, financial, or insurance advice and must not replace qualified human judgment.
We do not authorize automated tools to make a final decision about a person’s legal rights, insurance eligibility, credit, employment, or access to essential services. Review publication, contractor suspension, and material account actions require administrator involvement. We do not use homeowner project content to train public, general-purpose AI models unless we first provide additional notice and obtain any consent required by law.
8. Graystone advertising and insurance information
Landscape Genie displays advertisements for Graystone Risk Management and Insurance Services, Lic. #6016794. These placements are commercial advertising and may reflect a business relationship with the site operator. They are not a contractor ranking factor unless expressly disclosed, are not an insurance quote, binder, policy, coverage determination, or legal advice, and do not mean a homeowner’s or contractor’s existing policy covers a project. Coverage, eligibility, exclusions, limits, and pricing depend on the insurer and application. Clicking an ad takes you to a separate website governed by its own terms and privacy practices.
9. Contractor and administrator portals
Portal users must protect access codes and sessions, use only their authorized license or administrator account, keep information accurate, and promptly report suspected unauthorized access. Contractors may receive only work categories they selected when routing conditions are met, but no volume or quality of leads is guaranteed. A contractor may pause delivery, and an administrator may activate, suspend, correct, or remove a profile or content to protect users, comply with law, respond to public-record changes, or enforce these Terms.
10. Acceptable use
You may not:
- submit false projects, impersonate another person or contractor, or misuse homeowner information;
- scrape, harvest, resell, mass-contact, or build a competing database from the service;
- probe, bypass, overload, reverse engineer, or interfere with authentication, rate limits, security, or availability;
- upload malware, unlawful recordings, infringing content, deceptive reviews, or private information without authority;
- use the service for discrimination, harassment, spam, illegal telemarketing, or any unlawful purpose.
11. Intellectual property
Landscape Genie’s branding, interface, original text, software, design, and compilation are owned by or licensed to the operator and protected by law. Public CSLB facts remain public facts. These Terms grant only a limited, revocable, nontransferable right to use the service for its intended purpose.
12. Disclaimers
To the maximum extent permitted by law, the service is provided “as is” and “as available.” We do not warrant that data is current or error-free; that any contractor is qualified for a particular project; that communications will be delivered; or that a project will be safe, lawful, permitted, insured, completed, or satisfactory. Nothing on the site is legal, engineering, tax, safety, licensing, or insurance advice. Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.
13. Limitation of liability
To the maximum extent permitted by law, Landscape Genie and its operator, personnel, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, contractor conduct, property damage, personal injury, failed communications, or disputes arising from work arranged independently through the service. Nothing in these Terms excludes liability that cannot legally be excluded, including rights provided by applicable California consumer law.
14. Your responsibility and indemnity
You are responsible for your submissions, communications, and agreements. To the extent permitted by law, you agree to defend and indemnify Landscape Genie from third-party claims caused by your unlawful use, your content, your violation of another person’s privacy or intellectual-property rights, or your violation of these Terms. This section does not require a California consumer to indemnify us for our own unlawful conduct.
15. Suspension and termination
We may restrict or terminate access, remove content, or suspend delivery when reasonably necessary for security, legal compliance, public safety, suspected fraud, license status, abuse prevention, or enforcement of these Terms. You may stop using the public service at any time and may request account or data action as described in the Privacy Policy.
16. Changes, severability, and assignment
We may update these Terms prospectively. The effective date will change, and material changes will be presented through the site or another reasonable notice. Continued use after the effective date means acceptance where permitted by law. If a provision is unenforceable, the remaining provisions remain effective. You may not assign portal access or these Terms without consent; we may assign them as part of a lawful reorganization or transfer of the service, subject to applicable privacy obligations.
17. California law and disputes
California law governs these Terms, without overriding nonwaivable consumer protections. Before filing a claim, please email us with your name, reference number if applicable, the issue, and the requested resolution so we can try to resolve it informally. Nothing requires arbitration or waives a right to small-claims court, a public-agency complaint, or any nonwaivable statutory remedy. Courts with lawful jurisdiction in California may hear unresolved disputes.
